1. Acceptance of Terms

By downloading, installing, or using WFR TrailTriage ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

WFR TrailTriage is a mobile application designed to help Wilderness First Responders document patient care using the SOAP note format. The App is a documentation tool and is not intended to provide medical advice, diagnosis, or treatment.

3. Intended Use and Limitations

3.1 Documentation Tool Only

The App is designed solely as a documentation tool for trained medical responders. It does not:

• Provide medical advice, diagnosis, or treatment recommendations
• Replace proper wilderness medicine training
• Substitute for professional medical judgment
• Guarantee accuracy of any medical information entered

3.2 User Qualifications

The App is intended for use by individuals with appropriate training in wilderness first response or emergency medical care. Users are responsible for ensuring they have the necessary certifications, training, and authority to perform medical assessments and provide care.

3.3 No Medical Emergencies

The App is not designed for emergency communications. In a medical emergency, call 911 or your local emergency number immediately.

4. User Responsibilities

As a user of WFR TrailTriage, you are responsible for:

• Ensuring the accuracy and completeness of all data you enter
• Complying with all applicable laws and regulations, including HIPAA and other healthcare privacy laws
• Maintaining the security of your device and any patient information stored in the App
• Using the App in accordance with your scope of practice and training
• Properly disposing of or securing exported patient data
• Following your organization's policies and procedures for patient documentation

5. Privacy and Data

Your use of the App is also governed by our Privacy Policy. All patient data is stored locally on your device, and you are responsible for maintaining its security and privacy.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or other harmful components
• The results of using the App will meet your requirements

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your data
• Any errors or omissions in the App's content
• Medical decisions made based on documentation in the App

8. Indemnification

You agree to indemnify and hold harmless Black Elk Mountain Medicine and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Medical care provided based on documentation in the App

9. Professional Standards

Users must maintain applicable professional standards and certifications when using the App for patient care documentation. The App does not grant medical authority or credentials.

10. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

11. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted in the App and on our website. By continuing to use the App after changes become effective, you agree to be bound by the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement
